Agreement to terms

By accessing or using BirdSpend, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use our service. These terms apply to all visitors, users, and customers of BirdSpend, operated by Better Socks LLC.

The service

BirdSpend is a software-as-a-service platform that helps businesses monitor, track, and optimize their spending on AI tools including OpenAI, Anthropic Claude, Google Gemini, and others. We provide dashboards, alerts, and AI-powered recommendations.

BirdSpend is currently in beta and available via waitlist. Features and pricing are subject to change before and after general availability.

Your account

• You must provide accurate information when creating an account
• You are responsible for keeping your login credentials secure
• You must be at least 18 years old and authorized to enter contracts on behalf of your business
• One account per business unless you have an Enterprise plan
• You may not share your account with people outside your organization

Acceptable use

You agree not to:

• Use BirdSpend for any unlawful purpose or in violation of any regulations
• Attempt to gain unauthorized access to any part of our systems
• Reverse engineer, decompile, or attempt to extract source code
• Use the service to harm, harass, or deceive others
• Resell or sublicense the service without written permission
• Upload malicious code or attempt to disrupt our service

Payment and billing

Paid plans are billed monthly in advance. Payments are processed securely by Stripe — we never store your full credit card information. All prices are in USD.

You may cancel your subscription at any time. Cancellations take effect at the end of your current billing period. We do not offer refunds for partial months, but we will consider refund requests on a case-by-case basis — just email us.

AWS Marketplace customers are billed through their AWS account and subject to AWS billing terms.

Free trial

We offer a 14-day free trial with no credit card required. At the end of the trial, you can choose a paid plan or your account will be paused. We will never charge you without your consent.

Your data

You own your data. We do not claim any ownership over the spending data, business information, or any other content you provide to BirdSpend. See our Privacy Policy for full details on how we handle your data.

You can export or delete your data at any time by contacting us. We will process all deletion requests within 30 days.

Our responsibilities and limitations

BirdSpend provides cost-monitoring and AI-powered recommendations based on the data you provide. Our recommendations are informational and not financial advice. You are responsible for any decisions made based on our platform.

We aim for 99.9% uptime but do not guarantee uninterrupted service. In the event of outages, we will communicate promptly and work to restore service as quickly as possible.

To the fullest extent permitted by law, BirdSpend's liability to you is limited to the amount you paid us in the three months prior to any claim.

Intellectual property

BirdSpend, its logo, design, and software are owned by Better Socks LLC. You may not use our name, logo, or branding without written permission. We grant you a limited, non-exclusive license to use BirdSpend for your internal business purposes.

Termination

We reserve the right to suspend or terminate accounts that violate these terms. We will give reasonable notice before termination unless the violation is severe. You may terminate your account at any time by contacting us.

Changes to these terms

We may update these terms from time to time. We will notify users by email at least 14 days before significant changes take effect. Continued use of BirdSpend after changes constitutes acceptance of the new terms.

Governing law

These terms are governed by the laws of the Commonwealth of Massachusetts, United States. Any disputes shall be resolved in the courts of Worcester County, Massachusetts.
