Terms of Service

These Terms of Service ("Terms") govern your use of BirdSpend (birdspend.com), operated by Better Socks LLC, a Massachusetts limited liability company ("we", "us", or "our"). By using BirdSpend, you agree to these Terms.

1. The Service

BirdSpend is an AI cost monitoring and analytics platform for small businesses. We provide spend tracking, team usage analysis, and AI-powered cost recommendations across AI tools including OpenAI, Anthropic Claude, Google Gemini, and others.

2. Account Registration

You must create an account to use BirdSpend. You agree to provide accurate information and keep it updated. You are responsible for all activity under your account and must keep your password secure. You must be at least 18 years old and authorized to enter into contracts on behalf of your business.

3. Free Trial and Billing

• All plans include a 30-day free trial. You will not be charged until day 31.
• We will send a reminder email 3 days before your trial ends.
• After the trial, your plan renews monthly. You authorize us to charge your payment method on file.
• Subscriptions auto-renew until cancelled. Cancel at any time before your renewal date to avoid the next charge.
• We do not offer refunds for partial months, except as required by law.
• Prices may change with 30 days' notice to your registered email address.

4. Acceptable Use

You agree not to:

• Use BirdSpend for any illegal purpose
• Reverse engineer, copy, or resell the service
• Attempt to access other users' accounts or data
• Introduce malware or interfere with the service's operation
• Use the service to provide competitive intelligence to a competing service

5. Your Data

You retain ownership of all data you enter into BirdSpend. By using the service, you grant us a limited license to process your data solely to provide the service. We do not sell your data. See our Privacy Policy for full details.

6. AI Recommendations

BirdSpend's AI cost recommendations are generated by Anthropic Claude and are provided for informational purposes only. We do not guarantee that following recommendations will result in any specific savings. Recommendations are based solely on data you provide and are not financial advice.

7. Availability and Uptime

We aim for high availability but do not guarantee uninterrupted service. We may perform maintenance with or without notice. We are not liable for losses arising from service downtime.

8. Limitation of Liability

To the maximum extent permitted by law, Better Socks LLC shall not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of BirdSpend. Our total liability shall not exceed the amount you paid us in the 3 months preceding the claim.

9. Disclaimer of Warranties

BirdSpend is provided "as is" and "as available" without warranties of any kind. We do not warrant that the service will be error-free, uninterrupted, or that results will be accurate or reliable.

10. Termination

You may cancel your account at any time. We may suspend or terminate accounts that violate these Terms. Upon termination, your access to BirdSpend ends, and we will delete your data within 30 days per our Privacy Policy.

11. Governing Law

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Worcester County, Massachusetts.

12. Changes to Terms

We may update these Terms from time to time. We'll notify you by email of material changes. Continued use of BirdSpend after changes constitutes acceptance of the updated Terms.
